The Toronto Small Claims Court is the busiest of the Small Claims Courts in Ontario. Read on to learn about the ins and outs of the Toronto Small Claims Court.
Address of the Toronto Small Claims Court
The Toronto Small Claims Court is centrally located at 47 Sheppard Avenue East in Toronto, Ontario Canada. There is parking available, though there is a $15 charge that covers you all day. This is important because you never know how long your court date at the Toronto Small Claims Court will last. Some individuals attempt to save money by parking on nearby Beecroft Avenue, but this is risky if you, say, pay for an hour and your hearing goes longer. For this reason, I recommend simply using the Small Claims Court parking lot service.
Phone Number for the Toronto Small Claims Court
There is a phone number that anyone can use to call the Toronto Small Claims Court and speak to court staff. It is 416-326-3554. Note, the best times to call are generally between 8:30 a.m. and 9;30 a.m. and then again from 3:30 p.m.and 4:30 p.m. That is not to say that the wait will be short whenever you call, but generally the wait is shorter (or less long!) at these times.
You should never call the court and expect legal advice. Indeed, the small claims court’s greeting will tell you that court staff cannot provide legal advice. Court clerks will be helpful with respect to procedure only. This is important to realize because I have often been called by many people who have been told things by court clerks that, in all practicality, are unrealistic and/or unnecessary. For example, a court clerk may tell you that email service of a Plaintiff’s Claim is invalid. Technically this is correct, but practically, if the Defendant ends up filing a Defence after email service, the fact that it was invalid has no real affect. A full explanation is beyond the scope of this blog post, but will be the subject of a future article.
Layout of the Toronto Small Claims Court
The Toronto Small Claims Court is found on the 3rd floor of 47 Sheppard Avenue East. That is where the court clerks are found for the purposes of answering questions, providing small claims court forms and filing documents. Trials and settlement conferences are also conducted on this floor. See other blog posts for articles describing what a trial and settlement conference is.
There are additional conference rooms on the 4th floor of 47 Sheppard where Settlement Conferences are also conducted. Your Notice of Settlement Conference will state what floor and courtroom (or you can ascertain that the floor is the 4th if the courtroom number is, for example, 407.) Alternatively, you can go to the 3rd floor and check for the court listings posted on the bulletin board to see where your case is being heard.
In addition to 47 Sheppard, Toronto Small Claims Court is also located at 45 Sheppard Avenue East which is right across from the 47 Sheppard Avenue building. 45 Sheppard is usually where motions will take place.
